These Terms govern website use only. Client services are governed by separate written proposals, contracts, statements of work, or other agreements.

Marketing outcomes depend on many factors beyond Freed Creative’s control. No article, checklist, workshop, example, audit, case study, estimate, strategy, or recommendation guarantees:

  • Leads
  • Revenue
  • Engagement
  • Conversion rates
  • Media coverage
  • Platform approval
  • Algorithmic performance

3. No Client Relationship Through Website Use

Viewing the website, submitting a form, sending an email, attending a public workshop, or downloading a resource does not create a client, fiduciary, confidential, employment, partnership, joint-venture, or agency relationship.

A client relationship begins only after all required parties enter into a separate written agreement.

When stated, such references identify the capacity in which the work was performed. Their inclusion does not mean that the applicable client currently engages, sponsors, or endorses Freed Creative.

Third-party names, logos, and trademarks remain the property of their respective owners.

This section is especially important for your agreement. Every legacy project should clearly say something like:

Work performed by Holly Freed while serving as Managing Partner at 1744 Marketing.

Do not suggest Freed Creative was the contracting agency when it was not.

6. User Conduct

You may not use the website to:

  • Submit malicious code
  • Interfere with website operation or security
  • Attempt unauthorized access to accounts, systems, forms, or data
  • Impersonate another person or organization

Do not submit confidential, proprietary, regulated, or sensitive information to Freed Creative through a public form for the purpose of having it processed by an AI system.

To the fullest extent permitted by law, Freed Creative’s aggregate liability arising from website use will not exceed the greater of:

  • The amount you paid Freed Creative specifically for access to the website during the six months preceding the claim, or
  • One hundred U.S. dollars

This limitation does not apply where liability cannot legally be excluded or limited.
